ALTA 22 Endorsement in Florida

The ALTA 22 endorsement is a title insurance endorsement that provides coverage for survey and location matters, protecting the insured against losses caused by encroachments, boundary violations, and discrepancies between the survey and the property's legal description.

Coverage Details

The ALTA 22 endorsement insures against three primary risks: improvements on the insured property that encroach onto adjoining land or into easements, violations of setback lines or building restriction lines by existing structures, and encroachments from neighboring properties onto the insured land. This coverage supplements the base title policy, which typically excludes survey matters unless specifically endorsed.

Florida Practice

In Florida commercial transactions, lenders routinely require an ALTA 22 endorsement along with a current ALTA/NSPS land survey. The survey must meet ALTA/NSPS standards and be certified to the title company, lender, and borrower. The title company uses the survey to evaluate whether encroachments or violations exist and to determine the premium for the endorsement. Without a current survey, the endorsement cannot be issued.
