Architectural Control Committees in Florida
An architectural control committee (ACC) is the body within a Florida community association responsible for reviewing, approving, and enforcing standards for property modifications and exterior improvements. The ACC ensures that changes to individual properties maintain the community's aesthetic standards and property values.
Authority and Standards
The ACC's authority derives from the community's declaration of covenants, conditions, and restrictions (CC&Rs). Florida Statute Section 720.3035 requires HOA architectural standards to be written, publicly available, and applied uniformly. The ACC evaluates applications based on these published guidelines, considering factors such as architectural style, building materials, color schemes, setbacks, and impact on neighboring properties.
Homeowner Rights
Florida homeowners have the right to receive a written decision with stated reasons for any denial. They can appeal ACC decisions to the board of directors and, if necessary, seek mediation or judicial review. Owners who proceed with alterations without ACC approval face enforcement actions including fines, lien authority, and court orders requiring restoration of the original condition at the owner's expense.
