When to Use

Florida property owners pursue boundary line agreements when conflicting surveys, ambiguous legal descriptions, shifted natural features, or encroachments create uncertainty about the true boundary. The agreement resolves the dispute without litigation and creates a definitive record for future transactions.

Documentation

The agreement should include a legal description of the agreed boundary, a survey sketch prepared by a licensed Florida surveyor, signatures of all affected owners (and their spouses for homestead property), notarization, and recording in the county official records. Quitclaim deeds may also be exchanged to conform title to the agreed line.
