Burden of Proof and Evidentiary Standards in Florida

Florida allocates the burden of proof based on substantive law, applying different evidentiary standards depending on the type of case and the specific issue being litigated.

Standard Allocation

Preponderance of the evidence applies to most civil claims. Clear and convincing evidence applies to fraud, punitive damages, will contests, and guardianship. Beyond a reasonable doubt applies to criminal prosecutions. The standard reflects the severity of consequences and the importance of the rights at stake.

Party Assignment

Florida generally assigns the burden to the party asserting a position: plaintiffs prove causes of action, defendants prove affirmative defenses. Statutory provisions may assign specific burdens (insurers proving exclusions, employers proving legitimate reasons). Understanding burden assignment is critical for litigation strategy and case preparation.
