Genetic Information Nondiscrimination in Florida
Genetic information nondiscrimination laws prevent discrimination based on genetic test results and family medical history. Both federal (GINA) and Florida law (§760.40) provide protections in employment and insurance contexts.
Federal Protections (GINA)
- Title I: Prohibits health insurance discrimination
- Title II: Prohibits employment discrimination (15+ employees)
- Cannot use genetic info in hiring, firing, or promotion
- Cannot request or require genetic tests
- Must maintain confidentiality of genetic information
Florida Protections (§760.40)
- Prohibits discrimination based on genetic test results
- Covers employment, insurance, and other contexts
- Provides state-level enforcement mechanisms
