Home Inspection Contingency in Florida
Florida's home inspection contingency is governed by the FAR/BAR contract forms. The As-Is contract (most common) provides a 15-day inspection period with broad cancellation rights. The Standard contract obligates seller repairs up to a specified limit.
FAR/BAR As-Is Contract
- 15-day inspection period (default)
- Buyer can cancel for any reason during period
- Deposit refunded upon timely cancellation
- Seller not obligated to make repairs
- Buyer can still negotiate repairs voluntarily
FAR/BAR Standard Contract
- Seller pays repairs up to repair limit
- Buyer can cancel if repairs exceed limit and seller refuses
- Specific repair request and response procedures
Waiving Contingency
Buyer loses cancellation rights, deposit at risk, accepts property as-is. Seller's Johnson v. Davis disclosure obligations remain regardless.
