Improvement Districts in Florida
An improvement district is a special-purpose unit of local government created to finance, construct, and maintain public infrastructure within a defined geographic area. In Florida, improvement districts are a primary mechanism for funding development infrastructure without relying solely on impact fees or general tax revenue.
Types of Florida Improvement Districts
- Community Development Districts (CDDs): Created under Chapter 190, Florida Statutes. The most common type for new residential and mixed-use developments. CDDs issue tax-exempt bonds to fund infrastructure and levy annual assessments on properties within the district.
- Municipal Service Taxing Units (MSTUs): Fund specific services (fire protection, road maintenance, stormwater) within a defined area of a county.
- Dependent special districts: Operate under the jurisdiction of a county or municipality for specific infrastructure purposes.
- Water management districts: Regional districts managing water resources and flood control.
Impact on Property Owners
Improvement district assessments directly affect property costs:
- Annual assessments appear on the property tax bill as a separate line item
- CDD assessments commonly range up to $5,000+ per year
- Assessments fund bond debt service (infrastructure construction) and operating costs (maintenance)
- Bond assessments continue for 20-30 years until fully repaid
- Sellers must disclose CDD assessments to buyers
Creation Process
- CDDs under 1,000 acres: Established by county or city ordinance
- CDDs over 1,000 acres: Petition to the Florida Land and Water Adjudicatory Commission
- All districts: Must register with the Florida Department of Economic Opportunity Special District Accountability Program
