In Camera Proceedings in Florida
In camera (Latin: "in chambers") refers to a judicial review or proceeding conducted privately, outside the presence of the jury and public. Florida courts use in camera proceedings when sensitive or potentially privileged information must be evaluated by the judge before deciding whether it should be disclosed, admitted, or kept confidential.
Common Uses in Florida Courts
- Privilege review: Judge examines documents claimed as attorney-client privileged or work product to determine if the privilege applies
- Public records exemptions: Court reviews government records to determine if a claimed statutory exemption is valid
- Trade secret protection: Review of confidential business information during discovery disputes
- Sealed records: Examination of juvenile, adoption, or mental health records before unsealing

Procedure
The typical in camera process in Florida:

- The court orders an in camera review, meaning the judge alone examines the material
- The judge issues a ruling: the information is either disclosed, redacted and disclosed, or maintained under seal
- The reviewed materials are typically sealed and preserved in the court file for appellate review
Public Access Considerations
Florida’s Constitution (Article I, Section 24) creates a strong presumption of open court proceedings. In camera review is an exception that requires a specific legal basis. The judge’s ruling is part of the public record, even if the underlying materials remain sealed.
