Judgment Notwithstanding the Verdict (JNOV) in Florida
JNOV (now called a renewed motion for judgment as a matter of law) asks the court to overturn the jury’s verdict when no reasonable jury could have reached the result. Under Rule 1.480(b), it is an extraordinary post-trial remedy that preserves the right of appellate review.
Requirements
- Must have moved for directed verdict during trial (preservation)
- Filed within 15 days after verdict
- Standard: no reasonable jury could have reached the verdict
- Evidence viewed in light most favorable to the non-movant
When Granted
- Verdict legally unsupportable
- Evidence overwhelmingly one-sided
- Jury applied wrong legal standard
- Not for disagreement with credibility determinations
Directed Verdict Connection
- Directed verdict: motion during trial (Rule 1.480(a))
- JNOV: renewed motion after unfavorable verdict (Rule 1.480(b))
- Same standard; failure to move during trial waives JNOV right
