Material Facts in Florida Real Estate
A material fact is any fact that would likely affect a reasonable person’s transaction decision. Both sellers and agents (Section 475.278) must disclose known material facts. The standard is objective: would it "significantly and adversely" affect a reasonable buyer’s decision?
Examples
- Property condition, environmental conditions
- Zoning restrictions, pending litigation
- Assessments, liens, neighborhood conditions
- Association issues, title defects
Agent’s Duty
- Disclose all known material facts (Section 475.278)
- Applies regardless of representation
- Failure: license suspension, civil liability, potential criminal
Materiality Standard
- Objective: reasonable person test
- Affects value, desirability, safety, or intended use
- Fact-specific; may be decided by jury
