Definition: Any fact that would significantly influence a reasonable person's decision to enter into a transaction. In real estate, sellers and agents have a legal duty to disclose known material facts that affect the value or desirability of the property.

Material Facts in Florida Real Estate

A material fact is any fact that would likely affect a reasonable person’s transaction decision. Both sellers and agents (Section 475.278) must disclose known material facts. The standard is objective: would it "significantly and adversely" affect a reasonable buyer’s decision?
