Mechanics Liens (Construction Liens) in Florida
A mechanics lien (Chapter 713) is a legal claim against property for unpaid construction work. Available to contractors, subcontractors, and material suppliers. Priority dates back to the Notice of Commencement. Must be recorded within 90 days and foreclosed within 1 year.
Who Can Lien
- General contractors, subcontractors, sub-subs
- Material suppliers, laborers
Requirements
- Notice to Owner: within 45 days (subs/suppliers)
- Claim of Lien: within 90 days of last furnishing
- Foreclosure: within 1 year of recording
Owner Protection
- Notice of Commencement with "no lien" provision
- Verify contractor payments to subs
- Require lien waivers before progress payments
