Mortgage Release in Florida
A mortgage release (satisfaction of mortgage) confirms the mortgage is paid and releases the lien. Section 701.04 requires the lender to record within 60 days of payoff. Failure results in a $500 statutory penalty, actual damages, and attorney fees. Unreleased mortgages cloud title.
Requirements
- Identify mortgage by recording information
- State paid in full; signed by mortgagee
- Record in county where mortgage recorded
- 60-day deadline (Section 701.04)
