Negative Amortization Mortgage

Definition: A mortgage in which the monthly payment is less than the interest due, causing the unpaid interest to be added to the principal balance. The loan balance increases over time rather than decreasing, potentially resulting in the borrower owing more than the original loan amount.

Negative Amortization Mortgages in Florida

Florida has no specific state prohibition on negative amortization, but federal QM rules and OFR regulation effectively restrict them. Brokers owe fiduciary duty to disclose risks (Section 494.0025). FDUTPA and TILA provide remedies for undisclosed negative amortization.
