Non-Conforming Use (Grandfathered)
A non-conforming use was legal when established but does not comply with current zoning. May continue indefinitely but cannot be expanded or intensified. Lost if abandoned (12-24 months non-use). If substantially destroyed (50-75%), cannot rebuild without variance or rezoning.
Rights
- Continue existing use indefinitely
- Routine maintenance and repairs allowed
- Protected "grandfathered" status
Restrictions
- No expansion or intensification
- No extension to additional property
- Substantial destruction terminates status
Abandonment
- Cessation for 12-24 months (local ordinance)
- Intent to abandon (or presumption)
- Cannot resume once abandoned
