Offer Presentation Duties

Definition: The legal obligations of a real estate agent to promptly present all offers and counteroffers to their client, regardless of the agent's opinion of the offer's merit. In Florida, failure to present an offer is a violation of the agent's duties and may result in disciplinary action.

Offer Presentation Duties in Florida Real Estate

Florida agents must present all offers to sellers (Admin Code 61J2-10.028) unless the seller provides written instructions otherwise. Cannot refuse low or unfavorable offers. Failure: FREC discipline (fines, suspension, revocation), civil liability, and breach of fiduciary duty.
