Partition Action

Definition: A partition action is a legal proceeding used to divide jointly owned real estate among co-owners when they cannot agree on how to manage, use, or sell the property. It allows the court to either physically divide the property (partition in kind) or order its sale and distribute the proceeds (partition by sale).

Partition Actions in Florida

A partition action (Chapter 64) allows any co-owner to force property division or sale, regardless of ownership percentage. Court orders partition in kind (physical division) or by sale (proceeds divided). Most residential cases result in sale. Costs (attorney fees, appraisal, commission) paid from proceeds (Section 64.081).
