Quantum Meruit Recovery

Definition: A legal doctrine allowing a party who has provided valuable services or materials to recover the reasonable value of those services, even without a formal contract. Used in construction and real estate when a contract is void, unenforceable, or absent.

Quantum Meruit in Real Estate

Quantum meruit ("as much as deserved") recovers reasonable value of services without an enforceable contract. FL application: services provided, defendant benefited, plaintiff expected pay. Recovery: market value (not contract price). Limitations: not available if valid contract exists, Statute of Frauds issues (Section 725.01), and plaintiff must prove value. Equitable remedy based on fairness.
