Quantum Meruit Recovery in Contract

Definition: An equitable remedy allowing a party to recover the reasonable value of services rendered or materials provided when no enforceable contract exists or the contract does not cover the services. Prevents unjust enrichment by compensating the party for the benefit conferred.

Quantum Meruit Recovery in Florida Contracts

FL quantum meruit is available when no enforceable contract exists, partial performance occurred, or unjust enrichment would result. Implied-in-law obligation. Cannot pursue with breach of contract simultaneously: if valid contract exists, sue for breach. Damages: market value of services (not contract price). Plaintiff proves: services, benefit, and reasonable value.
