Quasi Estoppel Inconsistent Position

Definition: An equitable doctrine preventing a party from taking a position inconsistent with a prior position when the inconsistency would harm another party who justifiably relied on the original position. Distinguished from equitable estoppel by not requiring a misrepresentation.

Quasi-Estoppel in Florida

Quasi-estoppel prevents unconscionably inconsistent positions. No misrepresentation or detrimental reliance required (unlike equitable estoppel). Applied when: prior position accepted, now seeking inconsistency, and unconscionable to allow. Examples: insurer accepting premiums then denying coverage, lender accepting late payments then declaring default. Equitable defense only, applied sparingly.
