Definition: Quit Title Claim, more commonly known as a “Quiet Title Action,” is a legal proceeding used to resolve disputes over property ownership and remove any clouds, defects, or competing claims on the title. The purpose of this action is to establish clear ownership and ensure that the property title is free from challenges. Once the court issues a judgment, it confirms the rightful owner’s title against all others. This process is essential when ownership records are unclear or when multiple parties assert rights to the same property.

Quit Title Claims in Florida

"Quit title" is a common misspelling of "quiet title." Chapter 65 action to establish ownership and remove adverse claims. Different from quitclaim deed (transfer document, not lawsuit). Filed in circuit court: complaint, lis pendens (Section 48.23), serve defendants, hearing, and judgment. A quitclaim deed may be part of a quiet title settlement.
