Quo Warranto Authority Challenge Government Action

Definition: A legal proceeding challenging the right of a person to hold a public office or a corporation to exercise a franchise. Quo warranto asks 'by what authority' the person or entity exercises the power claimed, and may result in removal from office or revocation of the franchise.

Quo Warranto in Florida

Quo warranto ("by what authority") challenges the right to hold office or exercise government power (Section 80.01). Filed by AG or person with standing. Circuit court for local; FL Supreme Court for statewide (Art. V, Sec. 3(b)(8)). Remedies: ouster, injunction, forfeiture, and declaration. Extraordinary remedy: only when no other adequate remedy exists.
