Reconveyance Deed

Definition: A reconveyance deed is a legal document used to transfer title of real property back to the borrower once a mortgage or deed of trust has been fully paid off. It serves as proof that the lender no longer has a financial interest in the property. The reconveyance deed effectively releases the lien and restores full ownership rights to the borrower.

Reconveyance Deeds and Mortgage Satisfaction

Reconveyance deed: returns title after deed of trust paid. FL uses mortgages, not DOTs; equivalent: satisfaction of mortgage (Section 701.04). Lender must record within 60 days of payoff. Failure: written demand, 30 days to comply, then lawsuit ($500 damages + fees). Unrecorded satisfaction: cloud on title, difficulty selling/refinancing, title insurance issues.
