Recourse Mortgage

Definition: A mortgage in which the lender may pursue the borrower's personal assets for any deficiency remaining after foreclosure. If the property sells for less than the mortgage balance, the lender can seek a deficiency judgment against the borrower for the shortfall.

Recourse Mortgages in Florida

FL recourse mortgage: lender can pursue personal assets after foreclosure. Deficiency judgment (Section 702.06): filed within 1 year; based on fair market value, not sale price. Enforceable 20 years (Section 55.081). Options: short sale, deed in lieu, cash for keys, or settlement. Get deficiency waiver in writing. Forgiven debt may be taxable (1099-C).
