Remand Case Returned Lower Court Action

Definition: An appellate court order sending a case back to the lower court for further proceedings consistent with the appellate court's decision. Remand occurs when the appellate court determines the lower court must take additional action.

Remand in Florida Law

FL remand: appellate court sends case back to lower court. Reasons: reversal (new trial), additional findings needed, or judgment vacated. Lower court must follow appellate instructions. "Law of the case" doctrine: appellate rulings binding on remand. After new ruling: either party can re-appeal. Successive appeals possible. Mandate formalizes the remand order.
