Definition: A lawsuit to recover specific personal property that is being wrongfully withheld by another person. The court orders the return of the property to the rightful owner, rather than awarding monetary damages.

Replevin Actions in Florida

FL replevin (Section 78.01): recover possession of personal property wrongfully detained. File complaint, verified motion (Section 78.055), hearing, and order. Plaintiff posts bond = property value. Sheriff seizes and delivers. Limited to personal property (not real). Defenses: superior right, lawful detention, SOL (4 years, Section 95.11(3)(g)), and counter-bond. Defendant can also post bond to retain.
