Restrictive Covenant Modification

Definition: The process of amending or removing deed restrictions that apply to real property. Modification may be accomplished through agreement of the affected property owners, court order, or expiration of the restriction's term.

Courts consider: changed conditions, unreasonableness, public policy, abandonment, and equitable factors. Courts reluctant; burden on party seeking change. vs. termination: modification changes terms; termination ends covenant entirely. Both require vote/court order and recording.
