Restrictive Covenant Running with Land

Definition: A deed restriction that binds not only the original parties but also all subsequent owners of the property. The restriction 'runs with the land' and is enforceable by and against future property owners who were not parties to the original agreement.

Running with the land: covenant binds all future owners. Requirements: touch and concern the land, intended to bind successors, in writing, and recorded. Created by: declarations (HOA/condo), deed restrictions, and easement agreements. Constructive notice via recording. Termination: expiration, vote, abandonment, merger, changed conditions, and MRTA (30 years). Record termination to clear title.
