Right to Speedy Trial in Florida
FL speedy trial: 6th Amendment, Art. I Sec. 16, Rule 3.191. Misdemeanors: 90 days; felonies: 175 days from arrest. If expired: notice of expiration, hearing within 5 days, recapture: 10 days (misdemeanor) or 15 days (felony). Failure: mandatory discharge (charges dismissed, cannot refile). Exceptions: defendant delays, unavailability, extraordinary events, and waiver. Barker test: length, reason, assertion, prejudice.
