Tenancy at Sufferance Holdover Occupant Status

Definition: A tenancy that arises when a tenant remains in possession of the property after the lease term has expired, without the landlord's consent. The holdover tenant has no legal right to remain but is not a trespasser until the landlord takes action to remove them.

FL holdover tenancy: remains after lease expiration without consent. Not trespasser. Landlord: evict (Chapter 83) or accept rent (creates periodic tenancy). Notice: residential 15 days (Section 83.57), commercial per lease. Self-help prohibited (Section 83.67). Double rent (Section 83.06): landlord may recover double rental value if holdover and rent not accepted. Lease double-rent clauses enforced. In addition to other damages.
