Unconscionability Defense Consumer Contract

Definition: A defense to enforcement of a contract or contract provision that is so unfair and one-sided as to be oppressive, typically involving both procedural unfairness in the bargaining process and substantive unfairness in the terms. Courts may refuse to enforce unconscionable provisions.
