Unconscionability Defense Contract Fairness

Definition: A defense to contract enforcement asserting that the contract or a specific provision is so one-sided and unfair that no reasonable person would agree to it. Courts may refuse to enforce unconscionable contracts or modify them to eliminate the unfairness.
