Undue Influence in Estate Contest

Definition: The exercise of improper influence over a testator that overcomes the testator's free will and results in a will, trust, or beneficiary designation that reflects the influencer's wishes rather than the testator's true intent.

Undue Influence in Florida Estate Contests

FL estate contests (Section 732.5165): will void if procured by undue influence. Contestant proves: confidential relationship, active procurement (selecting attorney, present at execution), and substantial benefit. Presumption shifts burden to beneficiary: prove decedent acted freely, had independent advice, and understood will. Evidence: isolation, dependency, vulnerability, changed plan, involvement in execution, and unusual provisions. Standard: preponderance. Expert testimony: gerontologists, psychologists.
