Definition: The improper use of a position of trust, authority, or power to pressure a person into entering a real estate transaction that they would not have entered voluntarily. Common in transactions involving elderly, disabled, or dependent persons.

Undue Influence in Real Estate

RE undue influence: property transfer voided if grantor unduly influenced. Scenarios: elderly owner pressured by caregiver, reverse mortgage abuse, and POA abuse. Red flags: elderly/ill grantor, grantee-initiated, isolation, no independent counsel, below FMV, changed plan, and grantee in trust position. Challengeable by: grantor, heirs, or guardian. Protection: independent counsel, capacity assessment, witnesses, video recording, and comprehensive estate plan.
