Undue Influence as Will Contest Ground in Florida

FL will contest ground: contestant proves presumption: confidential relationship + active procurement + substantial benefit. Active procurement (Carpenter v. Carpenter): present at execution, selected attorney, provided instructions, kept will, secured witnesses, isolated testator, and departed from prior plans. Burden shifts: beneficiary must rebut. Defenses: independent counsel (strongest), expressed intent, capacity, consistency, and no procurement. Totality of circumstances.
