Florida Unjust Enrichment Claims

FL unjust enrichment claim: file in circuit court. Allege: benefit conferred, awareness, acceptance, and inequitable retention. Include value. Discovery: invoices, testimony, expert appraisals. Defenses: express contract (bars claim), voluntary/gift, offsetting benefit, statute (4 years; Section 95.11(3)(k)), and no enrichment. Construction: subcontractor vs. owner (benefit = improvement). Lien (Chapter 713) preferred; unjust enrichment if lien waived/expired.
