Value in Use Appraisal

Definition: An appraisal method that determines a property's value based on its specific use to a particular owner, rather than its value in the open market. May differ significantly from fair market value if the property has unique features that benefit the current use.

Value-in-Use Appraisal in Florida

FL value-in-use: property value based on current use to current owner (vs. market value: highest and best use). FL tax: agricultural classification (Section 193.461: greenbelt) = use value (up to 90% tax reduction). Conservation (Section 193.501) = conservation value. Legal: eminent domain (just compensation may include special use value), divorce (business value-in-use vs. liquidation), and insurance (replacement cost in use). FL generally uses market value but considers value-in-use where appropriate.
