Variance Application

Definition: A request to the local zoning board for permission to deviate from a specific zoning requirement when strict compliance would create a practical difficulty or undue hardship for the property owner. Does not change the underlying zoning; provides a property-specific exception.

Zoning Variance Applications

Zoning variance: deviation from zoning code. Types: dimensional (setback, height, coverage) and use (different use; harder). File with Board of Zoning Appeals (BZA). Hardship standard: strict application deprives all reasonable use, unique to property (shape, topography), not self-created, and not detrimental to public interest. Process: pre-application, filing, notice (mail + sign), staff review, public hearing, and BZA vote. Timeline: 60-120 days. Standard is strict (exception, not rule).
