Venue Selection in Florida Litigation

FL venue selection strategy: home court advantage, convenience (witnesses, evidence), court culture (plaintiff/business-friendly varies), and speed (circuits differ). Plaintiff chooses by filing. RE: mandated where property located (Section 47.011: foreclosure, quiet title, partition). Contract: property, defendant’s residence, or performance. Waiver: defendant fails to raise in first response (Rule 1.060), participates without objecting, or agrees. Once waived: proceeds regardless. Raise immediately.
