Vicarious Liability Employer Doctrine

Definition: The legal doctrine holding an employer liable for the torts of an employee committed within the scope of employment, even if the employer was not negligent. Based on the respondeat superior principle that the employer benefits from the employee's work and should bear the associated risks.

FL Employer Vicarious Liability Doctrine

FL respondeat superior: employer liable when employee acts within scope (performing duties, work hours, furthering business). Scope test: authorization, time/place, purpose, and foreseeability. Includes: authorized tasks, incidental activities, foreseeable deviations. Excludes: personal errands, criminal (unless foreseeable). Direct liability: negligent hiring, supervising, retaining. Limiting: policies, training, supervision, insurance (CGL, auto, umbrella), background checks, and IC structure.
