View Easements in Florida

FL view easement: protects property view from obstruction. FL: NO implied right to a view. Must be expressly created: express grant (recorded), deed restrictions, or condo declaration. Enforcement: injunction (prevent obstruction), damages (diminished value), and HOA/condo enforcement. Limitations: specific view only (not all), natural growth may not be covered, and government action not prevented. Value: significant in FL (waterfront, beach, golf). Cost: neighboring owner may demand compensation.
