Definition: A lien that the property owner voluntarily places on their property as security for a debt, such as a mortgage, home equity loan, or deed of trust. Distinguished from involuntary liens, which are imposed without the owner's consent.

Voluntary Liens on Real Property

Voluntary liens on RE: owner pledges property as debt security. Created by mortgage/deed of trust, recorded (priority), enforceable via foreclosure. FL: judicial foreclosure state (lawsuit required). Encumbers property (transfers with it). Multiple allowed (priority by recording date). Sale: paid from proceeds (closing agent obtains payoffs, records satisfactions). Insufficient: short sale or seller brings funds. Removal without payoff: negotiation, subordination, partial release, and bankruptcy (lien strip). Consult attorney.
