Knowing and voluntary waiver: person understood right + consequences (knowing) and gave freely without coercion (voluntary). FL: higher standard for constitutional rights (trial, counsel, self-incrimination), lower for contractual. Court test: totality of circumstances (education, language, time, legal counsel opportunity, and inducements). Types: constitutional (plea, Miranda), contractual (liability, jury trial, subrogation), and employment (severance, age discrimination/OWBPA). Not enforced if person didn’t understand.
