Writ of Execution Judgment Enforcement

Definition: A court order directing the sheriff to seize and sell the judgment debtor's non-exempt property to satisfy a money judgment. The writ of execution is the primary tool for enforcing money judgments when the debtor does not voluntarily pay.

FL Writ of Execution: Judgment Enforcement

FL judgment enforcement: writ converts money judgment into actual recovery. Authorizes sheriff to: locate, seize, and sell non-exempt assets. Enforces state + domesticated foreign judgments (Chapter 55.501-55.509). Limited by exemptions (homestead: unlimited, wages, retirement). Challenges: asset identification, generous exemptions, out-of-state assets, bankruptcy, and judgment-proofing. Debtor’s exam (Rule 1.560): court-ordered, under oath, about all assets. Contempt if no-show. Perjury = felony. Critical collection tool.
