Ex Parte Communication Judicial Ethics

Definition: A communication between one party and the judge about a pending case outside the presence of the opposing party. Ex parte communications are generally prohibited to ensure fairness and impartiality in judicial proceedings.

FL Ex Parte Communication

FL ex parte communication: judge + one party without other present. FL Code of Judicial Conduct (Canon 3B(7)): prohibited for substantive matters. Purpose: fairness (equal opportunity). Consequences: judicial discipline (JQC: reprimand to removal), reversal, recusal, and attorney sanctions (FL Bar: suspension/disbarment). Exceptions: scheduling/admin, emergencies (TRO), court staff, other judges, and settlement (with consent). Must promptly notify other party of any substantive communication.
