FL Exculpatory Clause Enforceability

FL exculpatory clauses: relieve liability for negligence. Generally enforceable IF: clear + unambiguous (specifically mention "negligence"), conspicuous (not hidden), voluntary (no duress), and not against public policy. Four-part test: clear statement, conspicuous, voluntary, and no public policy violation. Unenforceable: intentional torts, gross negligence, statutory violations, and adhesion contracts. Residential leases: disfavored (unequal bargaining). Strictly construed against enforcing party.
