Definition: A photocopy of a legal document. In real estate and probate practice, courts and recording offices may require original documents rather than xerographic copies for filing and recordation.

Xerographic Copy (Legal)

Xerographic copy: photocopy by dry copying process. FL Evidence Code (Section 90.953): duplicates generally admissible same as originals. Exception: genuine authenticity question or unfair circumstances. Duplicate (Section 90.951(2)): any accurate reproduction. Authentication: witness comparison or certification. Insufficient: original required (wills Section 732.901, negotiable instruments UCC Section 673.501), authenticity disputed, and certified copy needed. Court: discretion to require original.
