FL HOA Year-Round Occupancy Requirements

FL HOA occupancy enforcement: must be in CC&Rs/bylaws. Enforcement: notice, fines (Section 720.305(2): up to $10/day after hearing), legal action (injunction), and lien (foreclose). Due process required. Owner rights: review CC&Rs pre-purchase, due process, grandfathering (Section 720.306(1)(d): no retroactive), challenge (unreasonable/selective), and petition to amend. Alternatives: minimum lease terms, rental caps, tenant screening, platform restrictions (Airbnb/VRBO), and seasonal fees.
