Yellow Dog Contract Employment Restriction

Definition: A historical employment agreement in which the employee agreed not to join or support a labor union as a condition of employment. Yellow dog contracts are now prohibited by federal law under the Norris-LaGuardia Act.

FL Employment Restrictions (Post-Yellow Dog)

FL modern employment restrictions (replacing yellow dog): non-compete (Section 542.335: reasonable time/area/scope + legitimate interest), non-solicitation, confidentiality, and arbitration. FL right-to-work (Art. I, Sec. 6): cannot require union membership/dues. Does NOT affect non-competes. Limits: non-competes 6 months-2 years, legitimate interest required (trade secrets, customers, training), no undue hardship. FL courts: may reform (not void) overbroad. Consideration required. FL: employer-friendly enforcement.
