Zoning Estoppel

Definition: A legal doctrine that prevents a local government from denying a property owner's right to develop when the government previously approved the development and the owner has relied on that approval by making substantial expenditures.

Zoning Estoppel

Zoning estoppel: prevents government from enforcing zoning change against owner who relied on existing classification + invested. FL elements: good faith reliance, substantial expenditures/improvements, before zoning change, and inequitable to apply new zoning. Burden on owner. FL: case-by-case (Town of Largo v. Imperial Homes, 1974). Court examines: investment extent, permits obtained, government representations, and public interest. Equitable remedy, not guaranteed.
