Who Ensures Title Is Issued Properly at Closing
When closing on real property, many buyers and sellers assume there is a single person who attends closing and makes sure the title is issued correctly. In reality, issuing title properly is a coordinated legal and administrative process involving several parties, each with a specific role.
Understanding who is responsible and how the process works helps explain why some closings are smooth while others encounter delays or post closing issues.
The Title Company
The title company plays the central role in ensuring title is issued properly. Their responsibilities include conducting the title search, identifying title defects, issuing the title commitment, collecting required documents and payoffs, and ultimately issuing the title insurance policy after closing.
The title company is also responsible for recording the deed and related documents with the county and confirming that all requirements listed in the title commitment have been satisfied.
The Closing Attorney (When Applicable)
In many Florida transactions, a real estate attorney is involved either directly in the closing or in supervising the title process. When an attorney is involved, they provide legal oversight, review title issues, resolve complex ownership matters, and ensure legal compliance with Florida law.
While not every Florida closing requires an attorney to be physically present, legal guidance becomes critical in transactions involving probate, trusts, divorces, estates, or commercial property.
The Buyer and Seller
Although buyers and sellers are not responsible for issuing title, their participation matters. Sellers must provide accurate information, payoff details, and authority to convey the property. Buyers must review the title commitment and raise questions about any exceptions or requirements they do not understand.
Delays often occur when required documents or information are not provided in a timely manner.
The Lender
If the transaction involves financing, the lender plays a role in ensuring title is issued properly by reviewing the title commitment and requiring lender specific conditions to be met. The lender’s title policy protects their mortgage interest and must be issued correctly as part of the closing.
Who Is Ultimately Accountable
While several parties participate, the title company is ultimately responsible for issuing title insurance properly and confirming that the conditions required for coverage have been met. If a title defect later arises that should have been discovered or addressed, the title insurance policy and the issuing title company become the primary point of protection.
